The following are terms and conditions for the sale of goods that will govern any contract for sale that we enter into with you the consumer. Please read these terms and conditions carefully.

These Terms and Conditions tell you the rights and obligations you have. You may have other rights granted by law and these Terms and Conditions do not affect them. This does not affect your statutory rights as a consumer.

We would advise you to print these terms & conditions of sale for your own reference, as they form part of the contract for the sale of goods between Bigpockets.co.uk and you the consumer.

Purchasing from us
To purchase from us you must be over 18 years of age. Currently, we can only ship to limited countries (please check countries on checkout of web site). By submitting your order you are offering to buy the goods at prices and terms as stated, and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). We will not use your details for other purposes without asking your consent and you may ask that your details are removed from our system by writing to the address above. We are not obliged to supply the goods to you until we have confirmed acceptance of your order - Your order is deemed accepted when you receive a confirmation for despatch of goods, this is when the contract is made. You do not own the goods until we receive payment in full. If you discover you have made a mistake with your order please contact Customer Care immediately. Please do this before we confirm your order. If you order software from us you will also be bound by the terms of the software licence supplied with the software.

Product Images and Dye Codes
Product images displayed are for illustration purposes only and may differ from actual products received. Bigpockets endeavour to supply goods as per images shown, however manufactures do vary design and packaging and we reserve the right to supply identical items with alternative packaging without prior notice to the customer. Dye codes listed may differ from actual products received.  Bigpockets endeavor to supply correct information for all its products but can not guarantee the accuracy of the dye codes listed on our website.  If you receive any media with a different dye code then please inform us and we will endeavor to correct any incorrect products.

Views & Reviews
Views & reviews expressed by Bigpockets' customers (Bigpocketeers) displayed on the site are the views of those individuals, and are not the views or reviews expressed or implied by Bigpockets or any of its associates. Bigpockets cannot and will not be held responsible for any views or reviews posted or expressed by those individuals. Bigpockets will make every effort to ensure views and reviews by bigpockets' customers are as written or posted by individuals, and not amended for the benefit or products promotion or Bigpockets.

Product Conditions

New
Items will be new and will have the Original Manufacturers full warranty.

As New
Items will be in as new condition, but may have been returned to the Original Manufacturer as a failed or incorrect delivery. These items would then be fully tested and reboxed if needed by the Manufacturer and sold "As New" with the Original Manufacturers full warranty or covered by Bigpockets warranty which will be stated in the product description.

Refurbished
Items will be used but will have been professionally refurbished to the Manufacturers standard. They will be warranted for typically between 3-6 Months.

Used
Items will be used, but will have been thoroughly cleaned and tested by ourselves. They may have minor cosmetic scuffs or marks but will be in full working order, Used Items typically carry a 30 or 90 Day Return to Base Warranty from ourselves.

       

(IMPORTANT NOTE: customers using Switch should supply a "Start/Issue Date" and an "Issue Number" for the card where applicable, as well as card number and expiry date.)

Cooling-Off Period
By law you have the right to cancel any order within 7 working days of the day after the item is delivered to you. the right to cancel does not include certain goods or services i.e audio or video recordings or computer software if they are unsealed by the consumer. You need to write to us at :

or use our contact form: Contact Us and inform us in advance of you wish to exercise your right to cancel your order and fill in the returns section of our Contact Us form, get a RMA number and return the item to us. We will refund the orginal amount paid. All we ask is please take care of our goods, ensure all items are complete are in their original packaging, unused and in resalable condition. For your protection, please send items back well packaged and using a recorded delivery service.

If you do not return the goods within 21 days of cancellation we will collect the goods from you at your cost and will deduct the cost of collection from your refund, or if requested we will arrange collection of items at your cost.

All monies paid for cancelled goods will be refunded within 30 days from date of cancellation.

Please note: It is a legal requirement that you take care of the goods and you are responsible for the carriage costs of returning goods to us unless we delivered goods to you in error, or if goods are faulty.

Delivery
Over 98% of BigPockets orders processed before 3pm are dispatched the same day, Subject to the following:

(The term processed being cleared payment has been received and the order has successfully progressed through our automated systems before the daily cut off time.)
Bigpockets.co.uk will endeavour to dispatch same day any order placed before 3pm by Royal Mail or courier delivery service dependant on the service chosen and purchased. Delivery options information will be shown upon checkout where selections can be made.

We aim to deliver goods to you within the time scale indicated but we cannot give an exact delivery time or date. We also may deliver the goods in several consignments, but will not charge any extra delivery for this.
You will be informed by e-mail when your goods have been dispatched from our warehouse.

Should you have any problems

ie
* If you do not receive your goods within 7 days.

* You have items missing or your goods are damaged from delivery.

Please contact us immediately via the contact us page. If you do not contact us within seven working days from date of receipt, we may assume your goods have been delivered in perfect condition.

If we have not dispatched the goods within 30 days of expected delivery then you may cancel the contract. We will refund any monies paid by you.

If our couriers attempt to deliver your goods and no recipient was available to take delivery they will take your goods back to the local depot and hold your package for a duration of time depending on the delivery service used. If the package has not been successfully delivered or collected from the depot within the time scale given the order will be returned back to us and classed as a failed delivery. If your order has been classed as a failed delivery we can either re-send your order (at your cost) or a refund will be issued for the order less any costs incurred by us if there was genuine failure on your part to make arrangements for goods to be obtained or received.

We use established delivery services such as Royal Mail, Yodel, DPD, DHL and Evri among others depending on the service required. If you have a special requirement, conditions or request in relation to the delivery service you require please be sure to inform us before placing your order.

Damaged or defective goods
You should inspect your goods immediately upon delivery for defects, damages or shortage. Please note images used on our web site are for illustration purposes only and may differ from actual products received. If you find any defects or damages you must inform us by write to us as soon as possible and we will arrange the return of your goods, either to us, or the manufacturer. Warranty on all items, are RTB (Return to Base) excluding items damaged in transit, (these will be replaced at no cost to you). If the goods are found to be damaged or defective prior to delivery to you, we will repair or replace the goods or refund the price paid by you.

All hardware must be in their original condition, at date of receipt. Any modifications may invalidate warranties for the hardware. Flashed or modified hardware using authorised or unauthorised firmware is done at your own risk, and we cannot be held responsible for your actions in doing so. You will be required to send faulty flashed or modified hardware direct to manufacturer for repair or replacement.

Bigpockets Limited cannot be held responsible for losses or damages arising from failures of used or 2nd user goods supplied.

Your statutory rights as a consumer is not affected by this

Business customers
If you are a business or if the goods are used wholly or in part for business purposes we shall not be liable to you for any business loss including loss of profits (whether direct or indirect) business data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods. We do not exclude our liability for fraud or for death or personal injury. For our performance time is not of the essence. Returns are subject to a 15% Handling fee. You will not export any goods purchased from us in contravention of any International laws & by laws.

Returns
All Returns must have an issued RMA number, accompanied by Returns RMA form (with all requested information clearly visible). Warranty on all items are RTB (Return to base), item(s) must be returned at your cost unless item/s are sent to you in error (this is non-refundable). All second user hardware items are covered by a 30 day RTB warranty (unless stated otherwise). All items suspected to be damaged or faulty must be returned and tested, if no fault can be found or suspected fault replicated, then the item/s will be returned to you at your own cost (a handling charge of £25.00 may be incurred for testing hardware items with no faults found) or a refund for the item will be issued and the item restocked (Please note a 15% handling fee will be applied). We will only send replacement goods upon receipt of returned items. Please read Important notes on RMA form regarding the above terms.

To return any goods to us, your first must submit a ticket to our returns department and we will supply you with an RMA No. Please ensure that you clearly label all goods for return with your Name, Account Number, RMA number And Order number.

We advise you to print and keep safe a copy of these Terms and Conditions. Please send goods back to us using recorded delivery with insurance, we can not be held responsible for goods damaged in transit whilst returning to us.

Privacy
Bigpockets.co.uk are aware that you the consumer are concerned as to what happens with personal information provided by you. We respect your privacy and treat all information as private and confidential, we will only use information supplied by you for the purpose of internal accounts purpose, delivery of goods, and for us to keep in contact with you from time to time regarding your order progress. We may also use this information for improving our quality of service and inform you of promotional deals we are offering from time to time.
We do not and will not sell or release information provided by you to any other third parties, except when in connection with your orders, or in exceptional cases of debt recovery. Unless required by law.

Competitions
From time to time we may run promotions and/or competitions where prizes are available. In such cases, eligibility may depend on accepting certain terms which will be stated and made clear as part of the promotion. In general, winners will be notified by email. Should we not receive an acknowledgement of your acceptance of the terms of the particular promotion within 7 days of email contact we will assume you do not agree to the terms and pass the prize on to the next runner up or randomly selected participant. We advise adding our email address domain '@bigpockets.co.uk' to your email safe list to ensure you receive our emails and to avoid them being directed to junk mail folders.

The use of cookies enable us to keep track of your shopping patterns thus enabling us to identify you. Should you wish you can disable cookies through the browser settings.
